Who we are and what this service is

RecommendedByAI (“RecommendedByAI”, “we”, “us”, “our”) is an independent measurement and verification service operated by Technology Pro Bono S.L., a company established in Spain, with registered address at Núñez de Balboa 120, 28006 Madrid, Spain, CIF B88502364. What the service is

RecommendedByAI measures how frequently AI assistants recommend a given brand or model for a specific product category or purchase intent, using defined queries and, where applicable, web-grounded responses.

The service may produce factual records and badges stating, in substance, that a brand or model is “Frequently recommended by AI for <category>” as of a stated measurement date, together with the observed frequency, measured engines and a link to the underlying evidence.

What the service is not

RecommendedByAI is:

• not an endorsement, certification, ranking or rating of product quality;
• not a claim that a product is “best”, “#1”, “top-rated” or otherwise superior;
• not a guarantee or prediction of sales, traffic, conversion, visibility or commercial performance;
• not affiliated with, endorsed by or sponsored by OpenAI, Google, Perplexity, Anthropic, Shopify or any other AI or platform provider.

The service measures AI recommendation behaviour. It does not independently test product quality, safety, performance or fitness for purpose.

Nature of each claim

Every record is tied to a specific measurement date, category or intent, market and language. It is supported by an observed denominator and the engines included in the measurement.

AI outputs can change. A record therefore describes what was observed during the relevant measurement window and is not a permanent statement about how an AI assistant will behave in the future.

Staging and provisional status

Until RecommendedByAI expressly designates the service as publicly launched, the website, Shopify application, profiles, methodology, thresholds, badges, records and pricing may remain provisional.

During staging:

• example records and figures are for testing;
• criteria may be recalibrated;
• thresholds may change;
• features and pricing may change or be withdrawn;
• records must not be represented publicly as issued records unless RecommendedByAI has expressly designated them as such.

The C1–C7 eligibility framework is considered provisional until Phase 1 calibration has been completed.

Earned, not bought

A RecommendedByAI badge or record is earned through measurement evidence, not purchased.

Eligibility is determined by the published methodology and applicable criteria. No payment, subscription, pilot, partnership, contract or other commercial relationship may:

• create eligibility;
• alter eligibility;
• accelerate eligibility;
• preserve eligibility after the evidence no longer satisfies the criteria; or
• produce a more favourable measurement outcome.

Fees, where charged, cover services such as measurement, monitoring, display, historical reporting and analytics. They do not purchase the underlying eligibility status.

RecommendedByAI intends to maintain operational separation between commercial services and measurement eligibility.

Eligibility, criteria and revocation

A record for a (brand or model) × category/intent pair is issued only when the evidence satisfies the published C1–C7 criteria. The criteria are intended to include:

• C1 — Valid observations: a sufficient number of valid, resolved observations;
• C2 — Grounded-engine coverage: appearance across the required minimum number of grounded engines;
• C3 — Signal: recommendation frequency sufficiently separated from the relevant intent's null baseline;
• C4 — Round stability: sufficient stability within the measurement round, including split-half analysis where specified;
• C5 — Temporal maintenance: later rounds used to determine whether a previously issued record remains supported;
• C6 — Fresh evidence: evidence within the applicable 90-day evidence window;
• C7 — Existence and buyability: evidence that the relevant product exists and is buyable in the applicable market.

The exact numerical thresholds and methodology version applicable to each record are those published with that record.

Expiry

Records carry a measurement date and the underlying evidence is treated as current for 90 days, unless a particular methodology version states otherwise. Records are revalidated on a recurring cadence.

Automatic revocation

A record may be automatically revoked where the current measurement shows that the applicable eligibility requirements are no longer satisfied, including where:

• the signal falls below the applicable threshold;
• the required cross-engine consensus is lost;
• the evidence expires;
• the product is no longer demonstrably available in the relevant market; or
• a material data or methodology error is identified.

Where a badge is delivered through the Shopify application, the application is designed to auto-hide a revoked or expired badge. Where reasonably practicable, RecommendedByAI will notify the merchant before or around revocation. This notice is not a condition for revocation.

Accounts

Some services may require an account. You are responsible for:

• providing accurate information;
• keeping credentials confidential;
• activity carried out through your account; and
• promptly reporting unauthorised access.

The service is intended for adults and businesses. Users must be 18 or older, except where applicable law requires a higher age.

Acceptable use

You must not:

• scrape, harvest or bulk-extract RecommendedByAI records, evidence or content except as expressly permitted;
• manipulate or contaminate the measurement process;
• deliberately use RecommendedByAI's own published profiles or records to inflate future AI outputs for measurement purposes;
• use SEO/GEO tactics specifically intended to game the measurement;
• alter or selectively present records in a misleading manner;
• interfere with or probe the service's infrastructure or security;
• use the service unlawfully or to infringe third-party rights.

We may suspend or terminate access where reasonably necessary because of a breach, security risk, unlawful use or misuse of the service.

Badge licence

A merchant displaying a RecommendedByAI badge must comply with these Terms and the Badge & Claims Policy. RecommendedByAI grants a limited, non-exclusive, non-transferable and revocable licence to display the badge solely:

• for the specific brand/model;
• for the specific category or intent;
• in the applicable market and language;
• while the record remains valid; and
• in the approved, unaltered form.

The badge must retain its category, observed frequency, measured engines, measurement date and evidence link. The approved claim wording is: “Frequently recommended by AI for <category>.”

The licence ends automatically when the record expires, is revoked, the account is terminated where applicable, or RecommendedByAI withdraws the relevant licence for legal or policy reasons.

Intellectual property

RecommendedByAI's name, RBA seal/brandmark, website design, methodology text, software, evidence presentation, original content and other proprietary materials are owned by Technology Pro Bono S.L. or its licensors. Nothing in these Terms transfers ownership to you.

The merchant badge is licensed only for the purposes expressly described above. Third-party names and marks are used only to identify the AI engines measured and do not imply ownership, sponsorship or endorsement.

Non-affiliation with AI providers

Disclaimers

To the fullest extent permitted by applicable law:

• the service is provided on an “as is” and “as available” basis;
• RecommendedByAI does not guarantee uninterrupted availability;
• measurements may contain errors or limitations;
• AI assistant behaviour can change without notice;
• a record does not predict sales, traffic, conversion or future AI recommendations;
• a badge does not establish product quality, safety or suitability;
• third-party services may become unavailable or change their functionality.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

Limitation of liability

To the fullest extent permitted by applicable law, RecommendedByAI will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, data or business opportunity arising from the service.

For business customers, the aggregate liability of Technology Pro Bono S.L. arising from the service will not exceed the greater of: (1) the fees actually paid by the customer to RecommendedByAI during the 12 months preceding the event giving rise to the claim; or (2) €500.

This limitation does not apply to liability that cannot legally be limited or excluded. Nothing in this clause limits mandatory consumer rights.

Indemnification

For business customers, you agree to indemnify Technology Pro Bono S.L. against third-party claims and reasonable losses arising directly from:

• your unauthorised or misleading use of a badge;
• alteration or misrepresentation of a record;
• continued display after expiry or revocation;
• your unlawful use of the service; or
• infringement of third-party rights caused by your content or use.

This clause does not apply to the extent prohibited by mandatory law and does not exclude any liability caused by Technology Pro Bono S.L.'s own unlawful conduct.

Third-party services

RecommendedByAI may integrate with third-party providers, including infrastructure, hosting, security, merchant-platform and payment services. Examples may include Cloudflare and Shopify. Your use of third-party services may also be governed by those providers' own terms. RecommendedByAI is not responsible for independent failures or changes to third-party services, except where applicable law provides otherwise.

Changes

We may update these Terms. Material changes will be communicated through reasonable means where required. The updated version will state its effective date. Continued use after the effective date constitutes acceptance to the extent legally permitted.

Termination

We may suspend or terminate an account or service where necessary because of:

• breach of these Terms;
• fraud or manipulation;
• security concerns;
• legal requirements;
• misuse of the badge;
• non-payment; or
• discontinuation of the relevant service.

On termination, badge-display rights end immediately unless otherwise stated.

Governing law and jurisdiction

These Terms are governed by the laws of Spain. For business-to-business disputes, the parties submit to the courts of Madrid, Spain, to the extent legally permissible. Nothing in this clause removes mandatory consumer-protection or jurisdiction rights that cannot lawfully be waived.
